TUPS.COM TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use shall constitute the entire understanding between the parties with respect to all matters which are referred to.

DEFINITIONS

Client users are those users who use Tups.com to find service providers.

Business Users are those Users (service providers) whose businesses are listed in the Tups.com directory.

This Agreement is governed by the laws of England and consequently any action relating to this Agreement must be brought in England. Affiliated Introducers irrevocably consent to the jurisdiction of the English courts. Should any contractual provision in these Terms and Conditions of Use, in whole or in part, be held to any extent to be illegal or unenforceable under any enactment or rule of law, that provision or part shall to that extent be deemed not to form part of these Terms and Conditions of Use and the enforceability of the remainder of these Terms and Conditions of Use shall not be affected. Tups.com reserves the right to change any part of this Agreement at any time.

CLIENT USER TERMS AND CONDITIONS OF USE

Tups.com Client Users are deemed to have agreed to be bound by all the Terms and Conditions of Use set out in this Agreement.

PROHIBITIONS
It is prohibited to copy, reproduce or distribute data for any purpose including compilation of databases, directory building, redistribution, issuing data verification questionnaires or for any unlawful purpose.  It is prohibited to use data from Tups.com for any marketing/advertising purposes.

DISCLAIMER
Tups.com will make all reasonable endeavours to provide a continuous Service but it is not possible to guarantee an uninterrupted supply – Tups.com relies on available technology and may be subjected to interruptions outside their control. Tups.com accepts no responsibility for consequential loss or damage of any kind caused by any terminations, interruptions, delays in operation or failures in transmissions, direct or indirect, howsoever caused, even if they have prior knowledge of the possibility of such loss or damage, including viruses, errors and omissions.

Tups.com do not guarantee or warranty and cannot be held responsible for the accuracy, suitability, legality or reliability of any information provided by Tups.com Business Users. We cannot guarantee or warranty the reliability, competence or qualifications of any Tups.com Business Users contacted via Tups.com (it is the Client Users’ responsibility to satisfy themselves as to the competence of Tups.com Business Users and to verify trade certificates and Trade Association Memberships). Client Users are advised to seek advice from qualified professionals to verify information / advice received via Tups.com. Tups.com does not guarantee or warranty the suitability, fitness or quality of goods or services provided by Tups.com Business Users contacted via Tups.com.

SECURITY
Tups.com complies with all procedures required by the UK Data Protection Act 1998, covering storage and disclosure of information.

Excepting those jurisdictions which do not allow any of the above Terms and Conditions of Use, use of the Tups.com Service binds the Client User to the Terms and Conditions of Use; Tups.com may modify or change these Terms and Conditions of Use at any time without notice to the Client User and the Client User is bound by the most current version. It is the responsibility of the Client User to check these Terms and Conditions of Use from time to time. In the event that a breach of these Terms and Conditions of Use occurs, Tups.com reserves the right to withdraw this Service without notice.

In order that Client Users may determine the exact location of Tups.com Business User businesses area map links are enabled via Multimap.com – this is intended only for personal use and copies may be taken only with the expressed permission of Multimap.com

BUSINESS USER TERMS AND CONDITIONS OF USE

Tups.com Business Users are deemed to have agreed to be bound by all the Terms and Conditions of Use set out in this Agreement.

Tups.com is an online business directory providing a targeted advertising platform for Tups.com Business Users. 

Tups.com Business Users can provide potential customers/clients/ with information about their service by way of their Tups.com business Profile – Tups.com Business Users can edit/delete Profile information at any time with immediate effect. Tups.com Business Users warrant that the services and products they supply will be of reputable standard and comply with all relevant statutory and regulatory controls and safety standards.

Tups.com will make all reasonable endeavours to provide a continuous service but it is not possible to guarantee an uninterrupted supply – Tups.com relies on available technology and may be subjected to interruptions outside their control. Tups.com accepts no responsibility for consequential loss or damage of any kind caused by any terminations, interruptions, deletion of files / emails, delays in operation, failures in transmissions, direct or indirect, howsoever caused, even if Tups.com have prior knowledge of the possibility of such loss or damage, including viruses, errors and omissions.

It is prohibited to upload material onto the Tups.com business Profile pages that is offensive, obscene, abusive, indecent, malicious, unlawful, incorrect, defamatory, menacing, misleading, unsuitable, likely to cause inconvenience or infringe the rights of any third party.

Excepting those jurisdictions which do not allow any of the above conditions, use of Tups.com binds Tups.com Business Users to the Terms and Conditions of Use; if any term or provision in these Terms and Conditions of Use shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law, that term or provision or part shall to that extent be deemed not to form part of these Terms and Conditions of Use and the enforceability of the remainder of these Terms and Conditions of Use shall not be affected.

We may modify or change these Terms and Conditions of Use at any time without notice to Tups.com Business Users and Tups.com Business Users are bound by the most current version.
